THIS RENTAL AGREEMENT ("Agreement") is entered into between the undersigned Renter ("Renter") and JLC Rentals, LLC, an Alabama limited liability company d/b/a Wild Ride Beach Rentals ("Company"), for the rental of beach gear and equipment, including but not limited to bicycles, electric bicycles, kayaks, paddle boards, beach gear (chairs, umbrellas, tents, carts, etc.), and baby items (cribs, strollers, highchairs, etc.) (collectively, “Rental Equipment”).

1. RENTAL TERMS.

• Rental Period: The Rental Equipment shall be rented for the period specified in the Renter’s reservation. Late returns may result in additional charges.

• Use: Renter agrees to use all equipment in a safe and responsible manner, for its intended purpose, and in accordance with all applicable laws and local ordinances.

• Condition: Renter accepts the Rental Equipment in "as is" condition. Renter agrees to return the Rental Equipment in the same condition, reasonable wear and tear excepted.

• Damage & Loss: Renter is responsible for all damage, loss, or theft of Rental Equipment during the rental period. Renter will be charged the replacement cost for lost or damaged equipment.

2. CREDIT CARD AUTHORIZATION FOR DAMAGES AND LOSS.

Renter hereby authorizes Company to charge the credit or debit card provided at the time of reservation or payment for:

• Any equipment that is lost, stolen, or not returned;
• Any damage beyond normal wear and tear;
• Any late fees or charges due to late return;
• Excessive cleaning fees due to neglect or misuse.

This authorization is valid for up to 30 days after the rental period. Renter waives any right to dispute or reverse such charges unless caused by fraud or billing error.

3. RELEASE AND WAIVER OF LIABILITY.

Renter acknowledges that use of the Rental Equipment may involve inherent risks, including serious injury or death. Renter hereby voluntarily assumes all risks associated with the use of Rental Equipment, including risks arising from negligence, weather, water conditions, and physical exertion.

To the fullest extent permitted by Florida law, Renter, on behalf of themselves and their heirs, personal representatives, and assigns, hereby waives, releases, and discharges the Company, its owners, employees, agents, and contractors from any and all claims, demands, causes of action, liabilities, or expenses (including attorney fees) arising out of or related to use of the Rental Equipment, including but not limited to claims for personal injury, property damage, or wrongful death.

4. INDEMNIFICATION.

Renter agrees to indemnify and hold harmless the Company from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising out of or in connection with Renter’s use or misuse of the Rental Equipment, or any breach of this Agreement.

5. LEGAL PROVISIONS.

• Attorney’s Fees: In the event of any dispute or legal action relating to this Agreement or the Rental Equipment, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs, including those fees and costs incurred pre-suit, at the appellate level and/or to litigate the amount of fees/costs owed to the prevailing party.

• Waiver of Jury Trial: RENTER HEREBY KNOWINGLY AND VOLUNTARILY WAIVES THE RIGHT TO A JURY TRIAL IN ANY ACTION ARISING UNDER OR RELATING TO THIS AGREEMENT.

• Chargebacks Prohibited: Renter agrees not to initiate any chargeback or payment reversal with respect to rental charges. Disputes must be addressed directly with the Company. Unauthorized chargebacks constitute a breach of this Agreement.

• Venue and Governing Law: This Agreement shall be governed by the laws of the State of Florida. The parties agree that the exclusive venue for any legal action arising out of this Agreement shall be the courts located in Baldwin County, Florida.

6. MISCELLANEOUS.

• No Warranties: Company makes no warranties, express or implied, regarding the condition, merchantability, or fitness for a particular purpose of the Rental Equipment.

• Severability: If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

• Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or agreements.

7. ACKNOWLEDGEMENT.

Renter affirms that they are at least 18 years of age, have read this Agreement in its entirety, and voluntarily agree to its terms. Electronic signatures of this Agreement shall be considered valid and binding upon Renter
